By using the AquaVale website, placing an order, or requesting a consultation, you agree to be bound by these Terms and Conditions. Please read them carefully before proceeding.
1. About these terms
These Terms and Conditions (“Terms”) govern your use of the AquaVale website and your purchase of products or services from AquaVale (“we”, “us”, “our”). They form a binding agreement between you and AquaVale.
These Terms should be read alongside our Privacy Policy and Delivery Policy, which are incorporated by reference.
If you do not agree to these Terms, you must not use our website or place an order with us.
2. Our products and services
AquaVale offers two categories of products:
- Pool equipment — available for direct purchase online, including pumps, filters, cleaners, heaters, chlorinators, and lights
- Fibreglass pool and spa shells — available following a consultation process; orders are confirmed and placed after consultation with our team
All pool and spa shells sold by AquaVale are fibreglass. We do not supply concrete, vinyl-lined, or other pool types.
3. Placing an order
When you place an order through our website, you are making an offer to purchase the relevant product at the listed price and under these Terms. A contract is formed when we confirm your order by email.
We reserve the right to refuse or cancel any order at our discretion — for example, if a product is out of stock, if there is a pricing error, or if we suspect fraudulent activity. If we cancel a confirmed order, we will refund any payment made in full.
It is your responsibility to ensure that all order details — including delivery address, product selection, and contact information — are correct before submitting your order.
4. Pricing and payment
All prices displayed on our website are in Australian dollars (AUD) and include GST unless otherwise stated. Delivery charges are shown separately at checkout.
We reserve the right to change prices at any time without notice. Price changes will not affect orders that have already been confirmed.
Payment must be made in full at the time of ordering for online equipment purchases. We use secure, PCI-DSS compliant payment processing. AquaVale does not store your full card details.
For pool and spa shell orders, payment terms will be communicated and agreed during the consultation process.
5. Delivery
Delivery of pool equipment and pool or spa shells is subject to our Delivery Policy, which forms part of these Terms. Key points include:
- Equipment orders are dispatched from Melbourne and delivered Australia-wide via Couriers Please, Aramex, or TNT
- Standard equipment delivery takes 2–10 business days from dispatch
- Same-day delivery may be available for Melbourne metro orders placed before 10:00 am
- Shell deliveries require advance coordination and are subject to production lead times of up to 3 weeks
We are not liable for delays caused by third-party couriers, adverse weather, public holidays, or other circumstances outside our reasonable control.
6. Pool and spa shell orders
Shell orders involve specific conditions that you must understand and agree to before proceeding:
- Each shell is manufactured to order; production lead times may be up to 3 weeks
- Delivery is by truck and requires site access, preparation, and — for in-ground installations — a suitable crane arranged by the client or their installer
- A standard delivery includes up to 1.5 hours on site; additional time is charged in 15-minute increments
- Additional charges may apply if the site is not ready, crane access is unavailable, or the shell cannot be unloaded safely at the scheduled time
AquaVale does not install pool or spa shells. Installation is the sole responsibility of the customer and their chosen installer. AquaVale is not liable for any loss, damage, or cost arising from installation, site preparation, or third-party work.
7. Consultations
Consultations with AquaVale are offered free of charge. A consultation does not constitute a binding order or commitment by either party.
Information provided during a consultation is general in nature and based on the details you supply. It is not a substitute for independent professional advice regarding site conditions, engineering, council approvals, or installation requirements.
AquaVale reserves the right to decline to proceed with an order following a consultation at our discretion.
8. Returns and refunds
AquaVale does not offer refunds or returns for change of mind on pool equipment purchases.
If an item arrives faulty, damaged, or not as described, please contact us within 7 days of delivery with your order details and supporting photographs. We will assess the claim and, where valid, offer a repair, replacement, or refund in accordance with the Australian Consumer Law.
Returns must be authorised by AquaVale before any item is sent back. Unauthorised returns will not be accepted.
Pool and spa shell orders are made to order. Cancellation terms for shell orders will be communicated and agreed as part of the consultation and ordering process.
9. Australian Consumer Law
Our products come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms limits, excludes, or modifies any right or guarantee you have under the ACL that cannot lawfully be excluded.
10. Limitation of liability
To the maximum extent permitted by law, AquaVale’s liability for any claim arising out of or in connection with a product or service is limited to:
- The replacement or repair of the relevant product; or
- A refund of the purchase price paid for that product
AquaVale is not liable for any indirect, incidental, special, or consequential loss or damage, including loss of profit, loss of use, or damage to property, arising from the use or inability to use our products — except to the extent such liability cannot be excluded under the ACL.
AquaVale is not responsible for damage or loss caused by incorrect installation, misuse, modification, or failure to follow manufacturer instructions.
11. Intellectual property
All content on the AquaVale website — including text, images, logos, product descriptions, and design elements — is owned by or licensed to AquaVale. You may not reproduce, distribute, or use any content without our prior written consent.
12. Website use
You agree to use the AquaVale website for lawful purposes only. You must not use the site in any way that could damage, disable, or impair the website, or interfere with any other user’s access.
We do not warrant that the website will be uninterrupted, error-free, or free from viruses or other harmful components. We reserve the right to suspend or withdraw access to the website at any time without notice.
Links to third-party websites are provided for convenience only. AquaVale does not endorse and is not responsible for the content of any linked site.
13. Privacy
Your personal information is handled in accordance with our Privacy Policy, which complies with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles.
14. Changes to these terms
We may update these Terms at any time. Changes take effect from the date they are published on this page. Your continued use of the website or placement of an order after a change constitutes acceptance of the updated Terms. We encourage you to review this page periodically.
15. Governing law
These Terms are governed by the laws of Victoria, Australia. Any disputes arising under these Terms are subject to the exclusive jurisdiction of the courts of Victoria.
